1. Acceptance of Terms
Welcome to Cryptoyield. These Terms of Service (โTermsโ) constitute a legally binding agreement between you (โUserโ, โyouโ) and Cryptoyield Technologies Ltd. (โCompanyโ, โweโ, โusโ) governing your access to and use of the Cryptoyield platform, website, and all associated services (collectively the โServiceโ).
By creating an account, connecting a wallet, staking assets, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all visitors, users, and others who access or use the Service.
If you are using the Service on behalf of a business or entity, you represent and warrant that you have authority to bind that entity to these Terms.
2. Eligibility
To use Cryptoyield you must meet all of the following requirements:
- You are at least 18 years of age, or the age of legal majority in your jurisdiction, whichever is greater.
- You are not a resident of, or located in, a jurisdiction where the use of cryptocurrency staking services is prohibited, restricted, or requires a licence that we do not hold.
- You are not subject to any sanctions administered by OFAC, the UN Security Council, the European Union, or any other relevant governmental authority.
- You have full legal capacity to enter into a binding contract under the laws of your jurisdiction.
- You are not a Politically Exposed Person (PEP) unless you have received our explicit prior written approval.
We reserve the right to verify your eligibility at any time and to suspend or terminate accounts that do not meet these criteria.
3. Account Registration
To access most features of the Service you must create an account. When registering you agree to:
- Provide accurate, current, and complete information during the registration process.
- Maintain and promptly update your account information to keep it accurate and current.
- Keep your password and account credentials confidential and not share them with any third party.
- Immediately notify us of any unauthorised use of your account or any other security breach.
- Accept responsibility for all activities that occur under your account, whether or not authorised by you.
We reserve the right to refuse registration, suspend, or terminate any account at our sole discretion, including for violation of these Terms, fraudulent activity, or regulatory requirements.
One account per person. Creating multiple accounts to circumvent restrictions, earn duplicate referral bonuses, or for any other reason is strictly prohibited and may result in permanent account termination and forfeiture of all balances.
4. Staking Services
Cryptoyield offers crypto-asset staking services that allow users to deposit USDT and earn returns based on the applicable staking plan. By participating in staking you acknowledge and agree to the following:
- Staking plans have defined lock-up periods during which your principal may not be withdrawn.
- Returns (APY / monthly rates) shown on the platform are indicative and may change. Historic returns are not a guarantee of future performance.
- Staking rewards are calculated and credited at intervals specified in your chosen plan.
- Minimum and maximum staking amounts apply as published on the platform and may be updated by the Company.
- Level income and referral rewards are subject to the referral program terms, which form part of these Terms.
- Withdrawals are subject to processing times, network fees, and our anti-fraud review processes.
The Company does not guarantee any specific return, profit, or yield from staking activities. Crypto assets are volatile. You may receive less than you deposit.
5. Fees & Charges
The Company charges fees for certain Services as follows:
- Platform fee: a percentage of rewards earned, deducted automatically as disclosed at the time of staking.
- Network / gas fees: charged at cost for on-chain transactions; these are not controlled by us and may fluctuate.
- Early withdrawal fee: where applicable for plans with lock-up periods, an early exit fee may apply.
- Inactivity fee: accounts with no activity for more than 12 consecutive months may be subject to an inactivity fee.
All fees are disclosed before you confirm any action that incurs a charge. We reserve the right to introduce, amend, or waive fees with 14 days' notice published on the platform.
6. Risks & Disclaimers
Cryptocurrency and digital asset services carry significant risks. By using Cryptoyield you expressly acknowledge and accept the following risks:
- Market risk: the value of crypto assets can decrease substantially or go to zero.
- Liquidity risk: you may be unable to withdraw or liquidate your staked assets at a time of your choosing.
- Smart contract / technical risk: bugs, exploits, or failures in underlying protocols may result in loss of funds.
- Regulatory risk: laws and regulations governing crypto assets are rapidly evolving and may adversely affect the Service.
- Counterparty risk: we may rely on third-party custodians, exchanges, or liquidity providers whose failures may affect your assets.
- Cybersecurity risk: despite our security measures, the platform could be the target of hacks, fraud, or theft.
The Service is provided โas isโ and โas availableโ without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Prohibited Activities
You agree not to engage in any of the following activities:
- Money laundering, terrorist financing, or any other illegal financial activity.
- Using the platform with proceeds derived from any illegal activity.
- Creating fake accounts, manipulating referral programmes, or engaging in wash trading.
- Attempting to hack, penetrate, or disrupt the platform's infrastructure or security systems.
- Scraping, crawling, or automated data collection without our prior written consent.
- Distributing malware, spam, or any harmful code through the platform.
- Impersonating any person or entity or misrepresenting your affiliation with any person or entity.
- Engaging in market manipulation or any activity that artificially affects the price of assets.
- Violating any applicable local, state, national, or international law or regulation.
Violation of any prohibited activity may result in immediate account termination, forfeiture of assets, reporting to relevant authorities, and civil or criminal legal action.
8. Intellectual Property
All content, features, and functionality of the Service โ including but not limited to text, graphics, logos, icons, images, audio clips, and software โ are the exclusive property of Cryptoyield Technologies Ltd. or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes. You may not:
- Copy, modify, distribute, or create derivative works of any part of the Service.
- Reverse engineer, decompile, or disassemble any software component of the Service.
- Remove any copyright, trademark, or other proprietary notices from any part of the Service.
- Use our brand, logos, or trademarks without prior written permission.
9. Termination
Either party may terminate the relationship under these Terms at any time:
- You may close your account at any time by contacting support, subject to any outstanding obligations (e.g. active lock-up periods, pending withdrawals).
- We may suspend or terminate your account immediately and without notice for breach of these Terms, fraudulent activity, legal requirement, or at our sole discretion.
Upon termination, your right to use the Service ceases immediately. We will make reasonable efforts to return any unlocked assets to your designated wallet address within a commercially reasonable time, less any outstanding fees or amounts owed to us. Assets subject to active lock-up periods may be released only upon expiry of those periods, subject to our discretion.
10. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Cryptoyield Technologies Ltd., its directors, employees, partners, agents, or licensors be liable for any:
- Indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, revenue, data, goodwill, or other intangible losses.
- Damages resulting from unauthorised access to or use of our servers or personal information.
- Damages resulting from any interruption or cessation of transmission to or from the Service.
- Damages resulting from bugs, viruses, or similar harmful components transmitted through the Service.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the total fees paid by you to us in the 12 months preceding the claim, or (b) USD 100.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Cryptoyield Technologies Ltd. is incorporated, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall first be submitted to mediation. If mediation fails, disputes shall be referred to and finally resolved by binding arbitration under the rules of a mutually agreed arbitration body. The seat of arbitration shall be agreed by the parties, or determined by the arbitrator in the absence of agreement.
Notwithstanding the foregoing, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.
12. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes we will:
- Update the “Last updated” date at the top of this page.
- Send a notification to the email address associated with your account.
- Display a prominent notice on the platform for at least 14 days.
Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Service and may close your account.
